NOTICE IS HEREBY GIVEN that Applicant, Marathon Oil Company, has filed an application in this cause requesting the Corporation Commission of Oklahoma to enter an order, to be effective as of the date of the execution thereof or as of a date prior thereto, as follows: (i) amending Order No. 486310 to delete Section 28, Township 3 North, Range 5 West of the IM, Grady County, Oklahoma, from the purview and boundaries of the Goddard common source of supply as covered by such order, and to vacate the 640-acre non-horizontal drilling and spacing unit previously formed by such order for such common source of supply in said Section 28; (ii) amending Order No. 738832 to enlarge and extend the boundaries of the Goddard common source of supply so as to cover and include said Section 28, and to form a proper horizontal well unit in such section for such common source of supply, which unit should be formed as a 640-acre horizontal well unit; (iii) determining that the 640-acre horizontal well unit requested to be formed in this cause for the Goddard common source of supply in said Section 28 shall exist concurrently with (a) the 160-acre non-horizontal drilling and spacing unit previously formed for the Deep Springer common source of supply in the NW¼ of said Section 28, (b) the 80-acre non-horizontal drilling and spacing units previously formed for the Deep Springer common source of supply in the SE¼ of said Section 28, and (c) the 160-acre non-horizontal drilling and spacing unit formed for the Downthrusted Springer common source of supply in the NE¼ of said Section 28; and (iv) granting such other and further relief as may be proper based upon the evidence presented at the hearing herein. The application in this cause states that Applicant has proposed the development of the common source of supply in the unit involved herein under a plan of development and has proposed to commence such plan of development of such unit by an initial well in the lands covered hereby. Such application further states that Applicant has been unable to reach an agreement with the owners of drilling rights named as respondents herein with respect to such proposed plan of development of the common source of supply in the unit covered hereby. Such application further requests up to 365 days within which to commence operations on or in connection with such initial well under such plan of development. Such application further states that there is currently pending before the Commission an application of Applicant to form a 640-acre horizontal well unit in said Section 16 for the Goddard common source of supply. NOTICE IS FURTHER GIVEN that the application in this cause requests that Marathon Oil Company or some other party recommended by Applicant be designated as operator under the order to be entered herein of the common source of supply in the unit covered hereby, including the initial well and any subsequent well or wells to be drilled under or otherwise covered by Applicant's proposed plan of development of such unit.
